Three Individuals, Including Lawyer Chacha Mwita, Arraigned on Terrorism Financing Charges

Three people, including Nairobi-based lawyer Andrew Chacha Mwita, appeared before Hon. Gideon Kiage at Kahawa Law Courts on Thursday, facing terrorism-related charges. 


The accused, also comprising Mariam Ali Abdalla and Stephen Kiveve Musembi, are charged under the Prevention of Terrorism Act for allegedly supporting activities linked to the Islamic State East Africa (IS-EA) cell.


Lawyer Chacha Mwita faces two counts of collecting or providing property for terrorist acts. According to court documents, he is accused of transferring funds from a cryptocurrency account tied to IS-EA using his M-Pesa account. 


Mwita denied the allegations, pleading not guilty to both charges, and was granted a personal bond of KSh 5 million, with two guarantors. 


The case has been scheduled for mention and disclosure proceedings on January 20, 2026.


Mariam Ali Abdalla is charged with two counts of dealing in property controlled by terrorist groups. Prosecutors allege that she facilitated a transfer of funds on August 22, 2024, using her mobile number, despite being aware the money was linked to IS-EA. 


Abdalla entered a not guilty plea, but the prosecution opposed her release on bond. She remains in custody at Lang’ata Women’s Prison, with a bond hearing set for December 8, 2025.


Stephen Kiveve Musembi faces similar charges, accused of facilitating a mobile money transfer connected to IS-EA operations on October 14, 2024. Musembi also pleaded not guilty and is currently held at Kamiti Prison. 


The court will rule on his bail on December 15, 2025, after a pre-bail probation report is prepared.


These cases reflect ongoing efforts by Kenyan authorities to disrupt financing networks that support terrorist activities. 


The Prevention of Terrorism Act empowers law enforcement to investigate and prosecute individuals suspected of providing resources to extremist groups, amid a regional context of heightened counterterrorism operations in East Africa.
