The Law Society of Kenya (LSK) has strongly condemned incidents of violence that disrupted the by-elections held on 27th November 2025 across several constituencies, including Malava, Kasipul, Ekerenyo, and Kabuchai/Chwele.

In a statement released on X, LSK President Faith Odhiambo highlighted that the unrest not only endangered voters and candidates but also undermined the credibility of the electoral process.

LSK noted that the by-elections, covering constituencies such as Baringo, Magarini, Banissa, Mbeere North, Ugunja, and Kasipul, were overdue and essential for representing unrepresented communities.

Despite their routine nature, the campaign period was marked by heightened political tensions and sporadic clashes, signaling a high-stakes contest between major political formations.

The society criticized the Independent Electoral and Boundaries Commission (IEBC) and security agencies for apparent unpreparedness in handling potential unrest.

“Reports of unbridled violence and disorder during the polls reflect gaps in strategic planning by electoral stakeholders,” Odhiambo stated.

She emphasized that Kenya’s electoral framework, as per Article 81(e)(ii) of the Constitution, mandates elections to be free from intimidation, violence, and undue influence.

In addition to condemning the acts, LSK called for swift deterrent measures, urging security agencies and the Office of the Director of Public Prosecutions (ODPP) to identify and prosecute perpetrators under Section 11 of the Election Offences Act.

The statement also stressed the importance of comprehensive election preparedness ahead of the 2027 General Election, including reforms in voter registration, boundary delimitation, and institutional readiness.

LSK further appealed to political parties, civil society, and the public to engage constructively in safeguarding peace and upholding democratic norms.

“All Kenyans share the responsibility to protect national stability and prevent political interests from compromising electoral integrity,” Odhiambo added.
